“We’re looking forward to our day in court,” Baldwin’s attorneys, Alex Spiro and Luke Nikas, told Fox News Digital on Friday when the new fee was released.
In November, a video surfaced on the set of “Rust” showing crew members telling them to split up as he prepared to fire his gun.
Celebrity attorney, Christopher C. Melcher, partner at Walzer Melcher & Yoda, told Fox News Digital that the bombshell video may have been the catalyst for prosecutors to refile charges against Baldwin.

“The shots that were broadcast in the fall were both useful and negative to their defense. They showed him ordering a team member to move away from the direction Alec was pointing his gun,” Melcher said. “This establishes that Alec acted safely at the time when handling a gun (which is smart for him), but it also shows that he understood gun protection regulations (showing that he acted without regard for protection when he shot Halyna Hutchins) and Joël Souza). “
Hutchins was killed on the set of the western in New Mexico and director Joel Souza was wounded by a bullet from a gun he was holding while rehearsing a scene at a church on Oct. 21, 2021. He denied identifying the cause of the film that killed Hutchins.
“You wouldn’t expect the actors to be weapons experts, but Alec gave him a genuine gun and pointed it at two other people without checking if it was unloaded, or asking the prop master to do it for him. It’s a popular procedure to make sure the gun is unloaded when used on set,” Melcher said.

The video, released in November via NBC News, showed days before Hutchins’ death. You may simply be heard telling team members to move out of the canyon’s trail.
“Now wait a second. I’m going to shoot right,” Baldwin said. “Do you mind going to the other side of the camera? I don’t want to shoot toward you.” At another point, Baldwin seemed concerned for the safety of whoever is behind the camera, saying, “I don’t know why you’re going up hills and all this other — you’re going to break your f—ing neck.”

Baldwin was spotted in the Hamptons on Sunday, the first time the actor has been noticed since the new manslaughter charge was filed.

Kate Mangels, wife of Kinsella Holley Iser Kump, told Fox News Digital that the prosecution would possibly have stronger arguments against it this time around because of new tests on the gun, which she has strictly denied firing.
“Baldwin’s attorneys can argue that a review of a rebuilt gun with new parts cannot be evidence of what happened to the original gun,” Mangels said.
“They can also point to any inconsistencies between the two tests. In addition, evidence that Baldwin pulled the trigger is not dispositive of his guilt. The prosecution will still need to show evidence of his mental state and knowledge of the danger involved.”

He added: “It appears that prosecutors have conducted a more thorough forensic investigation of the gun and now have the evidence that was missing before, which is that the gun simply may not have fired without someone (i. e. Baldwin) pulling the trigger. ” “

Brand expert Eric Schiffer explained that when the charges first happened, people were upset and angry, and he “was not seen sympathetically,” but with time, perception seemed to change toward Baldwin, and he appeared to be gaining back some trust with the public.

However, he noted that jurors would now be less likely to err on Baldwin’s side. “Most will see this as some other celebrity looking to take responsibility for their actions, along with the fact that guns don’t magically happen, especially the ones that were working and validated through the FBI, which is a big deal for him. Schiffer told Fox News Digital.
“There are other people who feel like they’ve been through hell. Its reputation has been severely damaged. His film career was decimated, for which he paid a price, but not in the eyes of the law. “

Despite “Rust” forever having a hold over Baldwin, Schiffer believes Alec’s career could still possibly rise again.
“There’s a coin that gets a lot of attention even if it’s a negative sentiment, and that attention, over time, the reminiscence of the negative side goes away,” Schiffer said. “What doesn’t burn is the conscience of those individuals. As human beings, other people like or care more about the ones we know, even if it’s a negative feeling at first.

“He can get through this and eventually build back. Alec has tremendous talent. There’s a segment that is rooting that he gets through this, and there is a segment that says guns don’t go off, celebrity elites should not get favoritism, and he should face justice and let the jury decide.”

Baldwin still faces a handful of civil lawsuits, including one brought by “Rust” script supervisor Mamie Mitchell and another by Hutchins’ mother, father and sister. The plaintiffs are represented by attorney Gloria Allred.
Amid the legal drama, he and Baldwin, the crew and wrapped filming on “Rust” in May.
