The UK Competition and Markets Authority (CMA) showed (July 31) that JD Sports Fashion and Leicester City Football Club have breached festival law.
The authority sent an official notification to the sportswear store and the football club, which had agreed to “limit the festival on sales of Leicester City branded clothing, adding the reproduction kit, in the UK”.
On the fifth of July, Leicester City Football Club and its parent companies, Thai retail organisation King Power International, were fined £880,000.
JD Sports Fashion granted immunity from fines after admitting to the crime and signing a clemency agreement on June 30, in line with CMA policy.
The investigation into JD Sports and Leicester City Football Club was opened on 23 September 2021, pursuant to segment 25 of the Competition Act 1998.
JD Sports Fashion said it “takes note of the formal ruling issued through the Markets and Competition Authority (“CMA”) above in relation to Leicester City branded clothing, adding the reproduction kit. “
“This confirms the statement of objections that the CMA announced on July 5, 2023. As stated in the past, JD provided full and uninterrupted cooperation with the CMA in its investigation and, in bringing the matter to the CMA’s attention, was granted full immunity from any CMA fines. “
After JD Sports was fined last year for establishing the value of playback football shirts with Glasgow Rangers, the Markets and Competition Authority’s recent ruling to fine Leicester City and not JD Sports is not surprising. In particular, it demonstrates the cost to corporations that locate themselves involved in festival law infringement issues by bringing the issues to the attention of the CMA, i. e. mea culpa.
